Watch Out! False Weight Loss Claims Abound

Being overweight increases your risk of heart disease, type 2 diabetes, sleep apnea and even some cancers. And now you can add another risk to this list: being carried by fraudulent advertising of weight loss.

False claims in weight loss products ads have increased in the last 10 years, despite increasing law enforcement attempts to contain them, according to a new report released today by Federal Trade Commission (FTC) and Partnership for healthy weight management.

of 300 ads reprimanded television, radio, magazines, newspapers, e-mail spam, and other sources, new surveys show 40% of the ads contained at least one statement that "was almost certainly false," said the president of the FTC, Timothy J. Muris at a press conference today announcing the discoveries. Another 55% of the ads contained statements that researchers believed are likely to be false or that they had no appropriate proof.

The products themselves are not the target of the IRA of FTC, as many may have legitimate uses, says J. Howard Beales, director of the FTC consumer protection bureau. "But the allegations being made for them are just beyond the pale," he says.

And research shows that the situation is getting worse. The researchers compared announcements of magazines with similar ads that appeared in the same magazines in 1992, and discovered that magazines now have twice as much weight loss ads, says Muris. And the most recent ads were much more likely to claim as unrealistic results such as permanent weight loss without diet or exercise. They were also more likely to contain misleading promises, according to the report.

"Consumers are being ripped by products that do not work as promised," says Muris. "What this report shows is that, despite a dramatic increase in law enforcement in the 1990s, the situation was demonstrated worse in the amount of misleading and fraudulent ads that are out there."

Since 1990, the FTC filed 93 cases against false and misleading claims of weight loss.

The situation requires the action beyond the application of the law, says Murin, and this requested the FTC to sponsor a public meeting on November 19 to explore additional options. An approach is to appeal to media sources that carry these ads, asking them to adopt a self-regulating approach that will freeze some of the worst offenders of advertising circles.
